Terms of Service

Last updated: September 2026

Overview

Welcome to Morning Glory Coffee. These Terms of Service ("Terms") apply to your use of our webshop at https://morningglorycoffee.shop and to every order you place with us.

Our webshop is operated by Mornign Glory Shop, trading as Morning Glory Coffee ("we", "us", "our"), a company registered in the Netherlands. Our full company details are in section 1 and on our Company Details page.

These Terms are written to comply with Dutch law and with EU consumer law, in particular the Consumer Rights Directive (2011/83/EU), the Sale of Goods Directive (EU) 2019/771, and Books 6 and 7 of the Dutch Civil Code (Burgerlijk Wetboek, "BW").

Nothing in these Terms limits or removes your mandatory rights as a consumer. If any provision of these Terms conflicts with a consumer right you have by law, the law prevails and that provision does not apply to you.

Please read these Terms together with our:

Together, these documents form the agreement between you and us.

1. Who we are

Our webshop is operated by Morning Glory Shop, trading as Morning Glory Coffee, a company registered in the Netherlands. You can reach us at hello@morningglorycoffee.shop.

Our registered address, Chamber of Commerce (KvK) number, VAT number and telephone number are set out in full on our Company Details page, which is linked from every page of this website.

We operate the official Morning Glory Coffee webshop. The coffee we sell is roasted and packed by Morning Glory Coffee ("the Roaster"), our partner roastery. The Roaster is the food business operator responsible for the coffee itself and for the information on its packaging. Your purchase contract is with us, Morning Glory Shop, not with the Roaster — we are the seller and we are responsible to you for the order.

2. Who these Terms apply to

These Terms apply to consumers: natural persons acting for purposes outside their trade, business, craft or profession.

If you are buying in the course of a business, section 18 applies to you and the consumer-specific provisions (in particular the right of withdrawal in section 8 and the liability rules in section 15) apply differently or not at all.

To place an order you must be at least 18 years old and legally able to enter into a contract. If you are under 18, you may only order with the consent of a parent or guardian.

3. Our products

We sell pre-packed roasted coffee and brewing equipment and accessories (drippers, ceramics, filters, and similar).

We describe our products as accurately as we can. Please note:

  • Coffee is an agricultural product. Roast date, crop and seasonality mean that flavour and appearance vary naturally between batches. Tasting notes are descriptive impressions of the cup, not added ingredients or flavourings.

  • Colours and finishes of equipment and ceramics may appear differently on your screen depending on your device and its settings. Handmade or hand-finished items vary slightly from piece to piece.

Before you buy any food product, the mandatory food information required by Regulation (EU) No 1169/2011 — including the legal product name, ingredients, allergens, net quantity and storage conditions — is shown on the product page and summarised on our Food Information & Allergens page. The best-before date is provided with the goods on delivery.

For non-food products, safety information, manufacturer details and any warnings required by the General Product Safety Regulation (EU) 2023/988 are shown on the product page and explained on our Product Safety page.

We may change our range, discontinue products, or limit the quantity available to any one customer. Where we do, it does not affect orders we have already accepted.

4. Your account

You can order as a guest or create an account.

If you create an account, keep your login details confidential and do not share them. Tell us at support@morningglorycoffee.shop as soon as you believe someone else has access to your account. You are responsible for orders placed through your account unless you can show they were placed without your fault.

Please keep your details — especially your email and delivery address — accurate and up to date, so we can deliver your order and contact you about it.

You may close your account at any time from your account page or by emailing us. Closing your account does not cancel orders already placed or affect our legal obligation to keep transaction records (see our Privacy Policy).

We may suspend or close your account if you seriously or repeatedly breach these Terms, if we are legally required to, or where we have reasonable grounds to suspect fraud. Except where it would be unlawful or would compromise a fraud investigation, we will tell you why and give you an opportunity to respond. Suspension or closure does not affect orders we have already accepted and been paid for.

5. Placing your order

Here is what happens when you buy from us, and the point at which each of us is committed.

1. You place the order. When you click "Order with obligation to pay" at checkout, you are offering to buy what is in your basket at the price shown. Up to that point you can review and change your basket, your addresses and your payment details at every step, so please check the summary before you click.

2. We confirm we have received it. We email you an order confirmation straight away. That email is a receipt — it tells you we have your order, not that we have accepted it yet.

3. We accept when we dispatch. Your purchase becomes binding on both of us when we email you to say your order is on its way, or when it arrives, whichever happens first. If your order ships in more than one parcel, each item is accepted as it is sent.

Why there is a gap between 2 and 3. It lets us catch a problem before we take your money for something we cannot deliver. We may decline an order if an item turns out to be out of stock, if we cannot deliver to your address, if a price or description was obviously wrong (see section 6), or if we have good reason to suspect fraud or buying for resale. If we decline, we will tell you quickly and refund you in full. You are never left paying for an order we did not accept.

A note on the word "contract". You will see it throughout these Terms and in our other policies. It is the term EU consumer law uses — your right to change your mind, for example, is legally a right to withdraw from the contract, and the official withdrawal form uses the same word. It simply means your purchase.

Language and records. Your purchase is made in English, and in Dutch where we offer it. We do not keep a separate copy of your individual purchase terms for you to look up later, but your confirmation email contains all the details and these Terms are always on this page. Please keep that email.

6. Prices and payment

Prices. All prices shown to consumers are in euros (EUR) and include Dutch VAT (BTW) at the applicable rate. Delivery costs are shown separately and are added at checkout before you confirm your order. The total you will pay, including delivery, is always shown before you confirm.

Price changes. We may change our prices at any time, but the price that applies to your order is the price displayed when you placed it, as confirmed in your order confirmation.

Promotions. Where we announce a price reduction, we will state the lowest price we applied in the 30 days before the reduction, as required by Directive (EU) 2019/2161. Promotions may have their own conditions; where those conflict with these Terms, the promotion conditions apply to that promotion.

Payment. We accept the payment methods shown at checkout. Payment is taken when you place your order, or as otherwise indicated at checkout. Payments are handled by our payment providers; we do not store your full card details. You confirm that you are entitled to use the payment method you provide.

Errors. Despite our care, a price or product description in our webshop may occasionally be wrong. Where an error is manifest — that is, so obviously wrong that you could reasonably have recognised it as a mistake — we are not bound by it. In that case we will contact you before dispatch and offer you the choice of continuing at the correct price or cancelling, and we will refund you in full if you cancel. We will not simply cancel an accepted order because we would prefer a higher price.

7. Delivery

Our delivery countries, costs, dispatch and delivery times are set out in our Shipping & Delivery Policy, which forms part of these Terms.

In summary, and as a matter of law:

  • Unless we agree otherwise with you, we will deliver without undue delay and in any event within 30 days of the day you place your order (art. 18 CRD / arts. 7:9 lid 4 and 7:19a BW). If we miss that deadline, you may give us a reasonable additional period; if we still fail to deliver, you may terminate the contract and we will refund you in full without delay.

  • Risk passes to you when you — or someone you have nominated, other than the carrier — take physical possession of the goods (art. 20 CRD / art. 7:11 BW). If your parcel is lost or damaged in transit, that is our responsibility, not yours. This applies even where you chose and paid for a particular delivery service that we offered.

If you asked us to use a carrier of your own choosing that we did not offer, risk passes to you when the goods are handed to that carrier.

8. Your right of withdrawal (14 days)

As a consumer you have the right to withdraw from your purchase within 14 days without giving a reason, subject to the legal exceptions — most importantly that coffee and other sealed consumables cannot be returned once the seal has been broken, for reasons of health protection and hygiene.

The full rules, including how to withdraw, the model withdrawal form, return costs and refund timing, are in our Return & Refund Policy, which forms part of these Terms.

Once we have accepted your order, we cannot always stop it before dispatch. This does not affect your right of withdrawal above.

9. If something is wrong with your order (legal guarantee of conformity)

Separately from, and in addition to, your right of withdrawal, you are entitled by law to receive goods that conform to the contract: they must match the description, be of the quality and have the characteristics you can reasonably expect, and be fit for their normal purpose.

If goods do not conform, you are entitled, depending on the circumstances, to repair or replacement, and if that is not possible, not done within a reasonable time, or causes you significant inconvenience, to a price reduction or a refund. These are your rights under the Sale of Goods Directive (EU) 2019/771 and arts. 7:17 and following BW.

Under Dutch law there is no fixed cut-off after which goods stop having to conform: a product must last as long as you could reasonably expect for that type of product and price. Where a defect appears within one year of delivery, it is presumed to have existed at delivery unless we can show otherwise.

We do not offer a separate commercial guarantee on top of your legal rights unless we say so explicitly on the product page. Where a manufacturer offers its own guarantee, that is in addition to — and never in place of — your rights against us.

Please tell us at support@morningglorycoffee.shop as soon as reasonably possible after you notice a problem, with your order number and, where you can, photos. Where a return is needed because goods do not conform, we pay the return shipping.

Section 6 of our Return & Refund Policy sets out the procedure.

10. Coffee subscriptions

We offer subscriptions in two forms. Which one you have is shown before you subscribe and confirmed in your subscription email:

  • Rolling — no minimum term. Cancel before any delivery.

  • Minimum term — you commit to an agreed number of deliveries (for example 3, 6 or 12) at a better price. When that commitment ends, it simply continues as a rolling subscription.

Before you subscribe to either, we show you the price per delivery, how often deliveries come, and — for a minimum-term plan — the length of the commitment and the total you will pay over it.

10.1 Rules that apply to both

  • We charge your payment method before each delivery, at the price and frequency shown when you subscribed. We do not ask you to pay for a whole subscription in advance.

  • You can pause, or change the frequency, quantity, coffee or delivery address at any time from your account.

  • Delivery costs. Each delivery is charged at our normal rates, set out in our Shipping & Delivery Policy. If the value of an individual delivery is below our free-delivery threshold, our standard delivery fee applies to that delivery — the threshold is assessed per delivery, not across the subscription as a whole. Before you subscribe, and in every dispatch email, we show you the delivery cost and the total you will pay per delivery including it.

  • If you change your quantity or coffee so that a delivery moves above or below the threshold, the delivery cost changes with it. We show you the new per-delivery total before you confirm the change, and no notice period applies because the change is yours.

  • Cancelling is as easy as subscribing. You can do it in your account, or by emailing support@morningglorycoffee.shop. We will never require you to telephone us or write a letter.

  • Your 14-day right of withdrawal applies to every subscription. See section 10.4 below, which explains exactly when the 14 days start and what withdrawing does.

  • If a particular coffee becomes unavailable, we may substitute a comparable coffee of at least equivalent quality and price. We will tell you before dispatch, and you may cancel that delivery or the subscription.

  • We may end a subscription by giving you 30 days' notice, or immediately if payment repeatedly fails. We will refund anything you have paid for deliveries you will not receive.

10.2 Rolling subscriptions

  • Cancel at any time, with no cancellation fee, effective for deliveries not yet dispatched. Please cancel at least 5 days before your next scheduled dispatch so we can stop it in time; a delivery already dispatched will be charged and sent as normal.

  • If we change the price — including the delivery fee or the free-delivery threshold — we will email you at least 30 days in advance. The new price applies only to deliveries after that notice period, and you may cancel before it takes effect. If you cancel, you pay nothing further.

10.3 Minimum-term subscriptions

A minimum-term plan asks you to commit to an agreed number of deliveries — for example three bi-weekly deliveries — in exchange for a lower price. After those deliveries, it simply continues as a rolling subscription.

  • You are never asked to pay for the whole term in advance. As with every subscription, we charge your payment method before each delivery, at the agreed price. Your commitment is to receive and pay for the agreed number of deliveries, not to hand over the money up front.

  • Before you subscribe we show you the price per delivery, the delivery frequency, the number of deliveries in the commitment and the total you will pay over it.

  • You can still pause or change your coffee, quantity or frequency. Pausing moves the end date back rather than reducing the number of deliveries you receive.

  • We will not increase your price during the minimum term, and that includes the delivery cost: we will not raise our delivery fee or our free-delivery threshold for your committed deliveries. The per-delivery total you agreed is the total you pay for every delivery in the term.

  • Your subscription will not renew into a new minimum term. When your committed deliveries are complete, it continues as a rolling subscription under section 10.2, which you can cancel at any time before the next delivery. This is required by Dutch law (arts. 6:236 and 6:237 BW, the Wet van Dam), which prohibits tacitly renewing a consumer subscription into a further fixed term.

  • We will email you before your minimum term ends to tell you what happens next, what the rolling price will be, and how to cancel if you would rather stop.

  • You may end the minimum term early at no cost if we are in breach — for example if we repeatedly fail to deliver, or deliver coffee that does not conform.

  • If you want to end the minimum term early for your own reasons, you may. We will stop all future deliveries and charge you the difference between the discounted price you paid and our standard price for the deliveries you have already received — nothing more. We will tell you that amount before you confirm.

10.4 Your 14 days to change your mind

For any subscription, your right of withdrawal works like this, and this is set by law rather than by us:

  • The 14 days start the day after you receive your first delivery — not when you place the order (art. 9(2)(b)(iii) Consumer Rights Directive / art. 6:230o lid 1 BW).

  • It is one 14-day period for the whole subscription. Later deliveries do not start a new one.

  • Withdrawing ends the entire subscription, including any minimum term. You cannot be held to a commitment you cancelled within those 14 days, and we will not charge you for any delivery we have not yet dispatched.

  • Unsealed coffee cannot be returned, for hygiene reasons — see section 3 of our Return & Refund Policy. If your first bag is still sealed, you can return it and we will refund it.

  • If you withdraw close to your next scheduled dispatch, tell us as soon as you can and we will stop it. If we dispatch it anyway after receiving your withdrawal, that is our mistake: you owe nothing for it and we will refund you.

11. Complaints and disputes

If something is wrong, please contact us first at support@morningglorycoffee.shop. We aim to acknowledge complaints within 2 business days and to resolve them within 14 days. If we need longer, we will tell you and give you an indication of when to expect an answer.

If we cannot resolve your complaint together, you can obtain free, independent advice from ACM ConsuWijzer, the consumer information desk of the Dutch Authority for Consumers & Markets, at consuwijzer.nl. You may also bring the matter before a competent court in accordance with section 19.

We are not currently a member of a trustmark scheme or a sectoral disputes committee (Geschillencommissie). If we join one, we will state it here.

The EU Online Dispute Resolution (ODR) platform was permanently shut down on 20 July 2025. There is deliberately no ODR link in these Terms.

12. Using our website

You may use our website for lawful purposes only. You may not:

  • use it in any unlawful, fraudulent or malicious way, or in breach of applicable law;

  • infringe our intellectual property rights or those of anyone else;

  • harass, abuse, threaten or defame any person, including our staff;

  • upload or transmit malware, or attempt to gain unauthorised access to, interfere with, or damage our website, servers or security measures;

  • collect or harvest other people's personal data;

  • send unsolicited advertising or spam through our website; or

  • impersonate any person or misrepresent your identity.

We may restrict or withdraw access to our website where you breach this section. Where we do so, it does not affect orders we have already accepted.

Automated access and AI agents. You may not use robots, spiders, scrapers, data-extraction tools or autonomous or semi-autonomous software agents to access our website, except that general-purpose search engine crawlers may index our public pages in the ordinary way. Where we do permit agent access, an agent must identify itself as an agent in its user agent string, must not disguise itself as a human or circumvent measures designed to distinguish humans from software, must answer truthfully when asked whether it is automated, and must respect our robots directives and any technical measures we apply. We may block or limit agent access at any time.

13. Intellectual property

Our website and its content — including text, photography, product descriptions, tasting notes, graphics, layout and design — are owned by us or our licensors, including the Roaster, and are protected by copyright, database rights, trade mark law and other intellectual property rights under Dutch and EU law.

You may view, download and print pages from our website for your own personal, non-commercial use. You may not otherwise copy, reproduce, adapt, distribute, publish or commercially exploit any part of it without our prior written permission.

"Morning Glory Coffee", our logo and our product names are trade marks used under licence from the Roaster. You may not use them without written permission. Third-party names and marks appearing on our website belong to their respective owners.

14. Suggestions you send us

If you send us ideas, suggestions or feedback about our products or website, you agree that we may use them freely, without obligation to keep them confidential, to pay you, or to respond. Please do not send us anything you consider confidential or proprietary. This section does not apply to your personal data, which we handle in accordance with our Privacy Policy, and it does not affect your rights in anything you have created.

15. Our liability to you

We are liable to you for foreseeable loss and damage caused by our breach of these Terms or our failure to use reasonable care and skill. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, we do not exclude or limit our liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • our intent or gross negligence (opzet of bewuste roekeloosheid);

  • your statutory rights in respect of goods that do not conform to the contract, including your rights to repair, replacement, price reduction or refund;

  • our obligation to deliver goods and to refund you where required by law; or

  • liability under the Product Liability rules in arts. 6:185–6:193 BW.

Subject to the above, we are not liable for:

  • loss or damage that was not foreseeable at the time the contract was made — that is, loss that neither we nor you could have contemplated;

  • loss or damage caused by an event beyond our reasonable control, as described in section 16; or

  • business losses. We supply our products for domestic and private use. If you use them for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

Subject to the mandatory exclusions listed above, our total liability arising out of or in connection with any one order is limited to the greater of the total amount you paid for that order and EUR 500.

16. Events beyond our control

We are not responsible for delays or failures in performing our obligations caused by an event beyond our reasonable control — for example extreme weather, strikes, carrier failures, harvest failures, epidemics, fire, flood, or the acts of public authorities.

If such an event occurs, we will tell you as soon as reasonably possible and take reasonable steps to limit the delay. Where the delay is substantial, you may cancel the affected order and we will refund you in full for anything you have paid and not received.

17. Our website, and Shopify

We take reasonable care to keep our website available and accurate, but we do not promise that it will always be available, uninterrupted or free of errors, and we may suspend, withdraw or change parts of it for business or operational reasons. Where we can reasonably do so, we will give you notice.

Our website may contain links to third-party websites. We do not control them and are not responsible for their content or their handling of your data. Please read their terms and privacy notices before using them.

Morning Glory Coffee is powered by Shopify, which enables us to provide the webshop to you. Any sales and purchases you make in our store are made directly with Morning Glory Shop. Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from purchased products. Nothing in this paragraph affects your statutory rights against us or any rights you may have by law that cannot be waived.

18. Business (B2B) orders

If you order in the course of a trade, business, craft or profession:

  • the right of withdrawal in section 8 does not apply;

  • you must inspect the goods on delivery and notify us of any shortage, damage or non-conformity within 5 business days, failing which the goods are deemed accepted;

  • our liability to you is limited to the amount you paid for the order concerned, and we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of goodwill, except in the case of our intent or gross negligence; and

  • our products are supplied for resale only where we have expressly agreed this in writing.

Otherwise our products are supplied for your personal or household use and not for commercial resale or export.

If you do wish to place orders for commercial resale specifically for the coffee beans offered on site, please reach out to coffee@morningglorycoffee.nl to discuss the possibilities.

19. Governing law and jurisdiction

These Terms and any contract between us are governed by Dutch law.

If you are a consumer resident in another EU or EEA country, this choice of law does not deprive you of the protection of the mandatory rules of the law of your country of residence (art. 6 Rome I Regulation (EC) No 593/2008).

Disputes may be brought before the competent Dutch courts. If you are a consumer, you may also bring proceedings in the courts of the EU country in which you are domiciled, and we may only bring proceedings against you in the courts of the country in which you are domiciled (arts. 17–19 Brussels I bis Regulation (EU) No 1215/2012).

20. Changes to these Terms

We may change these Terms, for example to reflect changes in the law, in our products, or in how we operate.

The version of these Terms in force when you place an order governs that order. Changes never apply retroactively to orders already placed.

For ongoing arrangements such as subscriptions, we will give you at least 30 days' notice by email of any material change. If you do not accept the change, you may cancel before it takes effect, at no cost. The current version is always available on this page, with the date it was last updated.

21. General

Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is severed and the remaining provisions continue in full force.

No waiver. If we do not insist that you perform an obligation, or delay in enforcing a right, that does not mean we have waived it.

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to another business, and will tell you in writing if we do; this will not affect your rights.

Entire agreement. These Terms, together with the policies listed in the Overview, are the whole agreement between us about your use of our webshop and your orders. Nothing here limits liability for fraudulent misrepresentation, or your mandatory rights as a consumer.

Headings. Headings are for convenience only and do not affect interpretation.
